Polish Citizenship — who qualifies

By law at birth (primarily descent / jus sanguinis) 

  • You are Polish at birth if at least one parent is a Polish citizen at the time of your birth (anywhere in the world). Polish law also covers limited jus soli situations (unknown/ stateless parents) and certain foundling cases. Legal bases (Civil/Nationality Act):
  • Art. 14(1) – child acquires Polish citizenship if ≥1 parent is Polish; Art. 14(2) – child born in Poland to unknown/ stateless/ undetermined-nationality parents; Art. 15 – foundling on Polish territory; Art. 16 – full adoption before 16 → child is deemed Polish from birth.  
  • Constitution (principle): “Citizenship is acquired by birth of parents who are Polish citizens; other cases are set by statute.” (Art. 34). 
  • If you need proof (common in descent cases): apply for a Decision confirming possession of Polish citizenship (potwierdzenie posiadania obywatelstwa polskiego) via the voivode (in Poland) or with help from a consulate. 

Recognition as a Polish citizen (uznanie za obywatela polskiego ) — “residence route”

  • You may be recognized as a Polish citizen by the voivode if you lawfully reside in Poland and meet one of the statutory tracks (examples):
    • 2 years of continuous, lawful stay in Poland on a permanent residence / EU long-term resident / permanent right of residence and you’ve been in a marriage with a Polish citizen for ≥3 years, or you are stateless.
    • 2 years of continuous, lawful stay as a refugee granted in Poland.
    • 3 years of continuous, lawful stay on a permanent title with a stable income and legal housing.
    • 10 years of continuous, lawful stay + permanent title.
      (Other child/parent variants exist.) Applications are filed to the voivode; abroad, consulates can accept/forward where provided.

Grant of Citizenship by the President (nadanie obywatelstwa polskiego)

  • This is a discretionary route: the President of the Republic of Poland may grant citizenship regardless of residence length or other conditions.
    • Where to apply: in Poland via your voivode; from abroad via the competent Polish consulate.
    • The Chancellery explains the competence; consular pages (e.g., Embassy in the USA) give practical filing info and fees.  

Restoration of Polish Citizenship (przywrócenie obywatelstwa polskiego)

If you held Polish citizenship in the past and lost it (historical reasons defined by law), you may request restoration from the Minister of Interior; applications abroad can be submitted via a Polish consulate. 

Legal framework: restoration is regulated in the Polish Citizenship Act (2009); the single-text (ISAP) is the authoritative source. 

Citizenship by Repatriation (repatriacja)

Persons of Polish origin arriving to Poland on a national visa for repatriation, with the intent to settle permanently, acquire citizenship by operation of law on the day they cross the border (stamp confirms entry). Governed by the Repatriation Act of 9 Nov 2000; admin guidance available from voivodes/consulates. 

Helpful structural rules (worth knowing)

    • Dual nationality: Polish law recognizes that a Polish citizen may also hold another nationality; however, toward the Polish authorities you are treated only as a Polish citizen (no ability to invoke the other nationality in Polish proceedings). See Art. 3 of the Citizenship Act.

      • Recognition → Voivode in Poland.
      • Grant by President → via Voivode (in Poland) / Consul (abroad).
      • Restoration → Minister of Interior (can be filed via Consul).
